Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Outpush AI Studio platform ("Service"), operated by Outpush AI ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Service
Outpush AI Studio provides access to AI-powered tools for:
- Text generation — conversational AI and text completion
- Image generation and editing — creating and modifying images from text prompts
- 3D model generation — creating 3D meshes from text or images
- Speech synthesis — text-to-speech with multiple voices and languages
- Video generation — creating video from text or images
- Digital personas — creating and managing AI persona profiles
All AI processing occurs on our dedicated hardware. We use open-source and open-weight AI models. The Service is provided on an "as-is" and "as-available" basis.
4. Subscriptions and Credits
4.1 Plans and Pricing
The Service offers a free tier and paid subscriptions. Current plans:

Annual plans are available at a discount; the live pricing page shows current rates. New accounts also receive a one-time bonus of onboarding credits that expire 48 hours after first sign-in. We reserve the right to change pricing with reasonable notice. Existing subscriptions will be honored at their current rate until the next billing cycle after any price change.
4.2 Credit System
Each AI action consumes credits from your monthly allocation. Credit costs vary by quality tier and complexity:

Exact per-action costs are shown in the Studio interface before each generation. Additional features may be added with reasonable notice as they ship. Credits reset on the first day of each billing cycle. Unused credits do not roll over. Credits are non-transferable and have no cash value.
4.3 Billing
All payments are processed securely through Stripe. By subscribing, you authorize recurring monthly charges to your payment method. You may cancel your subscription at any time; access continues until the end of the current billing period.
4.4 Refunds
Subscription fees are generally non-refundable. If you experience a service outage or technical issue that prevents you from using credits, contact us and we will evaluate refund requests on a case-by-case basis.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Create deepfakes, non-consensual intimate imagery, or content designed to deceive or defraud
- Impersonate real individuals without their explicit consent (except through our persona features with proper authorization)
- Generate spam, phishing content, malware, or other malicious materials
- Violate any applicable law, regulation, or third-party rights
- Attempt to reverse-engineer, extract, or download the AI model weights
- Circumvent rate limits, credit systems, authentication, or other technical restrictions
- Use automated tools (bots, scrapers) to access the Service without our written permission, except through our documented API
- Resell, redistribute, or sublicense access to the Service without authorization
- Interfere with or disrupt the Service or its infrastructure
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of the prompts, images, writing samples, and other content you provide to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you.
6.2 Generated Content
Subject to these Terms and the licenses of the underlying AI models, you own the outputs generated by the Service in response to your prompts ("Generated Content"). You are responsible for ensuring your use of Generated Content complies with applicable laws and the model licenses listed on our About page.
We do not claim ownership of Generated Content. We do not use your prompts or Generated Content to train AI models.
6.3 Model Licenses
The AI models available through the Service are distributed under their respective open-source or open-weight licenses (Apache 2.0, MIT, Qwen License, Stability Community License, etc.). Commercial use of Generated Content may be subject to the terms of the underlying model's license. Please review the model licenses on our About page before using outputs commercially.
6.4 Our Intellectual Property
The Service, including its design, interface, branding, and software (excluding third-party AI model weights), is the intellectual property of Outpush AI and is protected by applicable intellectual property laws. You may not copy, modify, or distribute our platform without permission.
7. Digital Personas and Legacy Features
Our persona and "Ever After" legacy features allow you to create digital representations based on writing samples and personality data. By using these features:
- You represent that you have the right to use any writing or voice samples you upload
- You represent that you have obtained appropriate consent from any individuals whose data is used to create a persona
- You understand that AI-generated persona responses are approximations and may not accurately reflect the views or personality of the individual
- You acknowledge that sharing a persona with others grants them access to interact with it according to the permissions you set
- Legacy features involving deceased individuals require explicit consent during the individual's lifetime
8. API Access
Users on Pro or Studio plans may access the Service via our REST API. API usage is subject to the same terms, credit costs, and acceptable use policies as the web interface. API keys are your responsibility — treat them like passwords. We reserve the right to revoke API keys that are used in violation of these Terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- AI-generated content may be inaccurate, incomplete, biased, or misleading. You are solely responsible for reviewing and verifying all outputs.
- The Service does not provide legal, financial, medical, or other professional advice.
- We do not guarantee uninterrupted or error-free operation of the Service.
- We do not guarantee the quality, accuracy, or suitability of any AI-generated output.
- Model availability may change as we update or replace models over time.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTPUSH AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Outpush AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you generate, upload, or distribute through the Service
11.5 Outpush Voice — Additional Terms
The following terms apply specifically to use of Outpush Voice, our AI receptionist product for small businesses, in addition to the rest of this agreement.
SMS Notifications
When you sign up for Outpush Voice, you are asked to provide a mobile phone number to receive SMS notifications about calls to your business line. By checking the consent box on the signup form, you certify that:
- The phone number you provide is owned or controlled by you, or you are authorized to receive SMS at that number
- You consent to receive automated SMS messages from Outpush Voice at that number, including notifications when our AI captures a lead, billing alerts, and account-related messages
- You understand the approximate frequency (5–30 messages per month, varying by call volume) and that message and data rates from your carrier may apply
- You can opt out at any time by replying STOP, by emailing [email protected], or by toggling SMS off in your account settings

Caller Recording and Transcription
When a customer calls your business line and reaches our AI receptionist, the conversation is transcribed and may be recorded depending on your assistant configuration. You are responsible for compliance with all applicable state and federal laws regarding call recording and consent in your jurisdiction, including providing any additional disclosures required by two-party-consent states beyond what our AI provides automatically.
If you operate in or receive calls from California, Florida, Massachusetts, Pennsylvania, Washington, or any other two-party-consent jurisdiction, you should configure your assistant's greeting to include an explicit recording disclosure (e.g., "This call may be recorded for quality and lead-handling purposes"), or disable call recording entirely. Outpush AI is not liable for recording-related claims arising from your business's failure to provide adequate caller disclosure.
Acceptable Use
You may not use Outpush Voice to:
- Place outbound calls to numbers that have not consented to receive them, including numbers on Do Not Call registries
- Send SMS messages to recipients who have not opted in via the consent flow described above
- Solicit consent in a deceptive manner or hide the SMS consent checkbox at signup
- Use the service to harvest phone numbers or transcripts for marketing to third parties
- Configure the AI assistant to deceive callers about its nature as an automated system, except where local law explicitly permits this
Service Quality and Limits
- SMS delivery is best-effort and depends on carrier and network conditions. We do not guarantee delivery of every message.
- Each plan includes a monthly minute allowance and a hard cap. Calls beyond the cap are routed to voicemail without invoking the AI to prevent runaway costs.
- Per-call duration is capped at five (5) minutes by default. The assistant transfers to voicemail at the cap.
- Outage of upstream providers (Twilio, Vapi, OpenAI, ElevenLabs, Deepgram) may cause temporary unavailability. Outpush AI is not liable for damages caused by upstream provider outages.
Data Ownership
Call transcripts, lead records, and recordings associated with your business account are owned by you. You may export or delete them at any time. Outpush AI retains a non-exclusive license to process this data solely for the purpose of providing the service to you.
12. Termination
- By you: You may cancel your subscription and close your account at any time. Access continues until the end of the current billing period.
- By us: We may suspend or terminate your account for violation of these Terms, illegal activity, or prolonged inactivity. We will provide notice where practical.
- Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you should stop using the Service and cancel your subscription.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Outpush AI regarding the Service.
