These Terms of Service ("Terms") govern your use of pushpets.com, the Push Pets waitlist, and — when available — the Push Pets device and companion app, all provided by Outpush Games ("Push Pets," "we," "us"), based in Tampa, Florida. By using the site or joining the waitlist, you agree to these Terms. If you don't agree, please don't use the service.
Joining the waitlist reserves your place to be notified when the Push Pets Founders Edition — a small, numbered early production run — becomes available. Joining is free and does not create an order or a purchase obligation. Availability, pricing, features, timing, and quantities are not guaranteed and may change or be discontinued. We'll do our best to keep you informed.
When the store opens, purchases are subject to the pricing and details shown at checkout. Payments are processed by our payment provider (Stripe); by purchasing, you also agree to their terms. Any in-app currency (for example, "Treats") has no cash value, is non-refundable except where required by law, and may only be used within Push Pets features. We will honor applicable consumer-protection and warranty rights.
You agree not to misuse the service — including attempting to disrupt it, access it without authorization, reverse-engineer it except as permitted by law, or use it to violate any law or another person's rights. The companion app and any account are intended to be set up and supervised by an adult.
Push Pets, the Push Pets name and logo, the device design, artwork, characters, and site content are owned by Outpush Games and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the service and device for their intended purpose. You may not copy, resell, or create derivative works from our content without permission.
The service and any pre-launch information are provided "as is" and "as available," without warranties of any kind except those that cannot be excluded by law. We don't warrant that the service will be uninterrupted or error-free, or that pre-launch plans will be fulfilled exactly as described.
To the fullest extent permitted by law, Outpush Games will not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law (including certain consumer rights).
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Florida, unless applicable law provides otherwise.
We may update these Terms as Push Pets grows. We'll revise the "last updated" date above, and continued use after changes means you accept the updated Terms.
